Cabban Terms of Service

1. Acceptance of Terms

Welcome to Cabban (the "Software"), provided by Cabban ("we," "us," or "our"). By accessing or using the Software, you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Software.

2. Description of Service

Cabban is a property management software designed to make it easy for property managers to invite tenants, collect rent payment, review and address maintenance requests, and more. It gives tenants the ability to pay their rent on time, create maintenance requests, and see property listing information.

3. User Accounts

You must create an account to access certain features of the Software.
You are responsible for maintaining the confidentiality of your account credentials.
You agree to provide accurate and complete information when creating your account.
You are responsible for all activities that occur under your account.

4. User Content

You are responsible for any content you upload, post, or otherwise transmit through the Software ("User Content").
You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute your User Content for the purpose of providing the Software.
You represent and warrant that you have all necessary rights to your User Content and that it does not infringe on the rights of any third party.
You agree not to upload any illegal, harmful, or offensive content.

5. Communication and Notifications

By providing your phone number during account creation or at any point while using the Software, you expressly consent to receive text messages (SMS) and WhatsApp notifications from us regarding your account, property information, maintenance updates, payment reminders, and other relevant information related to your use of the Software.These notifications may include but are not limited to:

Account verification and security alerts.
Maintenance request updates and scheduling.
Rent payment reminders and confirmations.
Property-related announcements and updates.
Communication from property managers or landlords.

You acknowledge that message and data rates may apply depending on your mobile carrier.You can opt-out of receiving text and WhatsApp notifications at any time by removing your phone number in your account settings page or reply "STOP" to any message sent. Please note that opting out may affect your ability to receive important updates.We will make reasonable efforts to ensure the security and privacy of your phone number and communication data.

6. Intellectual Property

The Software and its content (excluding User Content) are owned by Cabban and are protected by intellectual property laws. You may not reproduce, modify, or distribute the Software or its content without our express written permission.

7. Limitation of Liability

We provide the Software "as is" and without warranties of any kind. We are not liable for any damages arising from your use of the Software, including but not limited to direct, indirect, incidental, or consequential damages. Our liability is limited to the extent permitted by law.

8. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the Software or your violation of these Terms.

9. Termination

We may terminate your access to the Software at any time for any reason.
You may terminate your account at any time.
Upon termination, your right to use the Software will cease immediately.

10. Nigerian Data Protection Regulation (NDPR)

We are committed to complying with the Nigerian Data Protection Regulation (NDPR). If you have any concerns about our compliance with the NDPR, you may contact the National Information Technology Development Agency (NITDA).

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website or through the Software. Your continued use of the Software after any changes constitutes your acceptance of the new Terms.
